MS Car Wreck or Accident - Another Death

Mississippi Car Wreck or Accident - David Parker McDonald Killed

David Parker McDonald, a Pascagoula, Mississippi resident, died over the weekend.  His death was due to a car wreck.  According to the Jackson County Mississippi Sheriff's Department, McDonald cross the center line and caused the wreck by crashing head-on into another car. At this time, it is unknown if the driver of the other vehicle was injured.

Mississippi Trucking Wrecks or Accidents

Title 49, Section 391.25 of the CFR requires a trucking company to review the driving record of every truck driver.  This review must happen at least once every 12 months.

This requirement is crucial because it helps prevent trucking accidents and wrecks.  The failure to review the driving record could mean a trucking company has failed to follow the law and thus allowed a truck driver with a poor driving record to continue to work for them.  This failure can lead to serious accidents and wrecks causing catastrophic injuries.

Trucking Accidents or Wrecks - Trucking Companies Are Required To Check a Driver's History Before Hiring Them

Title 9, Section 391.23 of the Code of Federal Regulations Requirments

Trucking Companies must investigate every truck driver before they hire them.  A trucking company is required by Section 391.23 to investigate 3 years of a truck driver's history in every state where the truck driver held a license.  They are also required to investigate the truck driver's employment record for the 3 years before they apply.  The investigation of the driving history must be made within 30 days of hiring the truck driver. The response from every State must be maintained in the driver's "qualification file."

The employment record investigation must also be made within 30 days of hiring the truck drive.  The trucking company or motor carrier as it is also know must keep a written record for each past employer that they contacted and it must include the employer's name, address, date of contact, and comments.  All of this information must be included in the driver's qualification file.

This requirement is crucial as we must ensure the safety of the public.  Proper investigations must be conducted to prevent unsafe truck drivers from getting behind the wheel of an 18 wheel truck.  If a trucking company fails to properly investigate a truck driver, this driver may be a extreme liability on the road and could cause a serious wreck which may result in serious injuries.

Wind versus Water: Insurance

In the history of the State of Mississippi, the idea that an insurance company could try and deny wind coverage because a flood also happened at the same time was not only against the law but it was preposterous.  However, given the election of a number of insurance company lawyers to our Courts, including our Supreme Court, the idea is not so preposterous.

The Mississippi Supreme Court recently had oral arguments on this debate.  You can view the video for the debate by clicking here.

We will watch closely to see how the decision comes out.
