Tasha Caudillo, the Mother who was driving her children and her mother, when she crashed into a ditch and sunk was on drugs at the time.  The wreck occurred near the Pascagoula River Bridge in Jackson County, Mississippi.  Unfortunately, Ms. Caudillo died in the wreck.  At the time of the car wreck she was driving 64.75 miles per hour in a 45 mph zone.  Fortunately, her children and mother lived.  Our thoughts and prayers are with the family.

A Jackson County resident has died due to a car wreck when she ran off the road near the Pascagoula Bridge.  Tosha Caudillo was driving a Jeep when she ran off the road and both of her children are in the hospital.

Unfortunately, another death happened on Kiln-Delisel Road.  It was a head-on wreck between a Ford Escort and a SUV.  The driver of the Ford Escort, Donna Harper, was not wearing a seat belt and died at the scene.

Mississippi Car Accidents and Wrecks, How Do I Know If My Lawyer Is Doing A Good Job?

If you are involved in a Mississippi car wreck or accident, it is very important to hire an experienced lawyer.  If, however, you have already hired a lawyer, this blog will discuss how you can tell if your lawyer is doing a good job on your case.

When you hire a lawyer you definitely want to make sure you are going to actually communicate with the lawyer you hired.  In other words, is the lawyer you saw in the telephone book or television ad the same lawyer that is actually handling your case or did your case get dumped on an associate?  If not, why did you hire that lawyer?  If the same lawyer is not handling your case, I would suggest looking for another lawyer.  In addition, is the lawyer that you hired talking to you on the telephone or are your calls to your lawyer being screened by his or her secretary?  Is the lawyer you hired for your Mississippi car wreck returning your telephone calls or is the lawyer not returning your telephone calls?

What type of injury do you have?  Is it a case of a severe, permanently disabling injury?  If so, the case may take longer to handle.  If not, and you have an injury where you were released within a couple of months from your doctor, has your lawyer promptly followed up with the insurance company to settle the case?

Highway 49 in Stone County, Mississippi was shut down by two 18 wheelers that wrecked.  The accident was near the Harrison County and Stone County line.  One of the truck drivers was taken to Forrest General Hospital for treatment for his injuries from the accident.  Large truck wrecks involving 18 wheelers is fairly common in South Mississippi.

Title 49, Section 390.3 of the CFR, which is the Federal Motor Carrier Safety Regulations for Trucks or 18-wheelers, requires that drivers and their employers be familiar with these regulations.  Specifically, in pertinent part, the regulation states, "Every driver and employee shall be instructed regarding, and shall comply with, all applicable regulations contained in this subchapter."

Obviously, this requirement is designed to help prevent trucking accidents and wrecks.

Title 49, Code of Federal Regulations 392.7

Title 49, Section 392.7 of the Code of Federal Regulations has certain pre-trip inspection requirements.  For example, before an 18-wheeler or truck can be driven on the road, a truck driver has a duty to inspect the truck to make sure certain parts and accessories actually work.  The truck driver must make sure that  the brakes work, including the parking brake, the lights work, the tires are okay, the horn works, and other safety devices.

Since 18-wheelers are on the road so much, this inspection is required for safety.  It helps prevents trucking accidents or wrecks involving 18-wheelers which could cause serious injuries.

Title 49, Section 392.9 of the Code of Federal Regulations requires the safe loading of a commercial motor vehicle such as an 18 wheeleror truck.  The 18-wheeler's cargo must be properly distributed and secured as required by Section 393.100.  We have seen many accidents or wrecks due to the improper distribution or failure to secure a load.

Frequently, trucking wrecks and accidents with 18 wheelers happens because the driver is in a hurry and speeding.  The truck driver is forced to speed because the trucking company has given the driver a schedule that cannot possibly be met without speeding.  However, Title 49 Section 392.6 of the Code of Federal Regulations provides, in pertinent part,

"No motor carrier shall schedule a run nor permit nor require the operation of any commercial motor vehicle between points in such period of time as would necessitate the commercial motor vehicle being operated at speeds greater than those prescribed by the jurisdictions in or through which the commercial motor vehicle is being operated."

Mississippi Workers Compensation Accident - "Workmans Comp" - Medical Proof

As we have talked about in our frequently asked questions, news, and library many times, a worker who is injured at work in a worker's compensation accident must have medical proof.  If an injured worker does not have proof through a doctor will say that their injuries were related to the accident, the case will be lost.  There simply is no exception to this rule.

In deciding a worker's compensation case today, Clark v. Spherion Corporation, the Mississippi Court of Appeals reaffirmed this long-standing rule and denied the injured worker treatment and benefits for the accident.  Of course, at our offices we agree with this rule.  Simply put, we agree that if a doctor will not related an injured worker's injuries to the accident that happened at work, then benefits and treatment should be denied.  What amazes us is that after all this time, we still have lawyers taking cases to trial that are clearly loser cases.

If you are an injured worker and your doctor has not told you that your injuries are related to the accident, then you need to ask him or her.  At a minimum, certainly, ask your lawyer if the medical records show your injury was related to the accident.
