Tasha Caudillo, the Mother who was driving her children and her mother, when she crashed into a ditch and sunk was on drugs at the time. Title 49, Section 390.3 of the CFR, which is the Federal Motor Carrier Safety Regulations for Trucks or 18-wheelers, requires that drivers and their employers be familiar with these regulations. Specifically, in pertinent part, the regulation states, "Every driver and employee shall be instructed regarding, and shall comply with, all applicable regulations contained in this subchapter."

Title 49, Section 392.7 of the Code of Federal Regulations has certain pre-trip inspection requirements. For example, before an 18-wheeler or truck can be driven on the road, a truck driver has a duty to inspect the truck to make sure certain parts and accessories actually work. The truck driver must make sure that the brakes work, including the parking brake, the lights work, the tires are okay, the horn works, and other safety devices.
Since 18-wheelers are on the road so much, this inspection is required for safety. It helps prevents trucking accidents or wrecks involving 18-wheelers which could cause serious injuries.

Frequently, trucking wrecks and accidents with 18 wheelers happens because the driver is in a hurry and speeding. The truck driver is forced to speed because the trucking company has given the driver a schedule that cannot possibly be met without speeding. However, Title 49 Section 392.6 of the Code of Federal Regulations provides, in pertinent part,
"No motor carrier shall schedule a run nor permit nor require the operation of any commercial motor vehicle between points in such period of time as would necessitate the commercial motor vehicle being operated at speeds greater than those prescribed by the jurisdictions in or through which the commercial motor vehicle is being operated."

Mississippi Workers Compensation Accident - "Workmans Comp" - Medical Proof

As we have talked about in our frequently asked questions, news, and library many times, a worker who is injured at work in a worker's compensation accident must have medical proof. If an injured worker does not have proof through a doctor will say that their injuries were related to the accident, the case will be lost. There simply is no exception to this rule.
In deciding a worker's compensation case today, Clark v. Spherion Corporation, the Mississippi Court of Appeals reaffirmed this long-standing rule and denied the injured worker treatment and benefits for the accident. Of course, at our offices we agree with this rule. Simply put, we agree that if a doctor will not related an injured worker's injuries to the accident that happened at work, then benefits and treatment should be denied. What amazes us is that after all this time, we still have lawyers taking cases to trial that are clearly loser cases.
If you are an injured worker and your doctor has not told you that your injuries are related to the accident, then you need to ask him or her. At a minimum, certainly, ask your lawyer if the medical records show your injury was related to the accident.
