Mississippi Car Wreck or Accident - Do I Get Loss of Use For My Car?

In Mississippi, if you are in a car wreck or accidnt, you may be entitled to loss of use of your car or truck due if you are unable to drive it. In fact, damages for loss of use of a car or truck may be measured by the cost of hiring or renting another car while repairs are being made. The reasonable rental value of a similar car or trucke is a measure of damages which has the virtue of certainty and fairness. National Dairy Products Corp. v. Jumper, 241 Miss. at 344, 130 So. 2d at 923. Further, the Mississippi Supreme Court held in the Jumper case that the reasonable value of a replacement car or truck may be recovered, even though no other was actually procured during the interval.
