If you are injured at work in a Mississippi Worker’s Compensation accident, there are certain “burdens” that you have as a person claiming you were injured. One of these burdens is the burden of proof is the burden regarding mental injuries. The burden of proof is raised when you claim a mental injury.
However, when the claimant seeks benefits as a result of a compensable mental injury, the burden of proof is raised to clear and convincing evidence of a causal connection between the injury and employment. Fought v. Stuart C. Irby Co., 523 So. 2d 314, 317 (Miss. 1988).
