The answer is yes and no.

If you had an injury before your workers comp injury and this did not cause you to have what I like to call a loss of wage earning capacity, then it does not matter. In other words, your previous injury does not affect your Mississippi workers comp case.

The Mississippi Supreme Court has ruled on this workers comp issue many times. While their opinions were less than clear in some cases, this issue has been cleared up by a number of cases. In Stuart’s, Inc. v. Brown, 543 So. 2d 649, 654 (Miss. 1989) , a workers comp case, the Mississippi Supreme Court stated “only pre-existing occupational disabilities generate a duty to apportion.” Id. Pre-existing, non-disabling conditions aggravating or prolonging compensable injury are not amenable to apportionment. Id. at 654.

Therefore, if your previous injury did not cause you to have a pre-existing handicap, disease, or lesion which resulted in an actual occupational disability then it does not affect your Mississippi workmans comp accident.
