Mississippi Workers Compensation Accidents and Injuries – What Is The Rule On Appeal Regarding The Failure to Raise An Issue At Trial?

If you are injured at work in Mississippi and you hire a Mississippi Worker’s Compensation lawyer, your lawyer must make sure that he or she brings up every issue at the trial. This includes every objection. The failure to bring up an issue before the Administrative Law Judge means that you cannot bring up the issue on appeal. This is true even if the error was egregious at the trial.

The Mississippi Supreme Court and Court of Appeals has stated many times this exact rule. Specifically, the Courts have held “in order to preserve an issue for review by this Court or the supreme court the issue must be raised before the Commission and circuit court by direct or cross-appeal. McElveen v. Croft Metals, Inc., 915 So. 2d 14, 20 (Miss. Ct. App. 2005) (quoting Sawyer v. Dependents of Head, 510 So. 2d 472, 474 (Miss. 1987)).
