Don’t Let Insurance Companies Determine “Recovery” For You.

 

The Mississippi Worker’s Compensation Commission oversees the laws and regulations that govern the responsibilities of an employer if an employee is injured on the job.  These laws are supposed to require the employer and its insurance company to take care of an injured employee who gets hurt at work.  However, the employer and the insurance company usually do not do what the law says.  Even when the insurance company and the employer follow the worker’s compensation law, the injured worker is going to suffer financially.

Unfortunately, the Mississippi’s workers compensation statutes are designed to help injured workers get by if the worst should happen.  For example, the most an employer is required to pay an injured worker per week in most cases is $422.31.  If you are hurt at work and the sole source of income, how are you going to pay all the bills?

It is hard to put a price on a person’s injuries, but the Mississippi Legislature has done so for many injuries that happen at work.  Many argue that the compensation the Mississippi Legislature provides is inadaquate for these injuries.  For example, if the injury may prevents you from ever approaching the wages you earned before the accident and a settlement will not replace this, is that fair?  Serious injuries on the job will require someone experienced to handle the case.

How does this happen?  It  happens because we vote to put certain legislators in office who love insurance companies.  These legislators will never vote to help an injured person but they do back flips to help insurance companies make a few more billion dollars a year.

For example, if you are hurt at work and your job requires you to do mostly heavy manual labor, how are you going to be able to  return to work doing the heavy manual labor if your injury prevents you from doing so?

Insurance companies and the insurance adjustors that work for them are not in business to help you.  They are in business to give you as little as possible and try to make you give up.

What we find interesting is that when the “shoe is on the other foot,” the insurance adjustor then does not think it is fair when the insurance company uses the same tactics.  How do I know?  Iknow because when people like yourself get injured at work, even insurance adjustors, they call me, Jay Foster, to help them.

Self-insured Employers: WATCH OUT!

Usually, if an employer has five or more full-time employees, the employer will be required to have workers compensation insurance.  Specifically, Section 71-3-5 of the Mississippi Code requires this.  Of course, as with many things, there are exceptions to this rule.  For example, employers of agricultural workers and domestic service workers are not required to carry worker’s compensation insurance.  Employers have some options, as many do, they can get worker’s compensation insurance coverage from an insurance company, who will gouge them on the insurance premium, or they can request the Mississippi Worker’s Compensation Commission allow them to be a self-insured company.  Self-insured employers are difficult to deal with as they are not experienced in handling worker’s compensation cases.
