MS Workers Compensation Accident or Injury – Carpal Tunnel Syndrome

Section 71-3-35(1) of the Mississippi Code provides that if a Mississippi Worker’s Compensation lawsuit is not filed within two years after the accident, then the statute of limitations has run and an injured worker can no longer make a claim. Jordan v. Pace Head Start, 852 So. 2d 28, 30 (Miss. Ct. App. 2002).

However, in regards to carpal tunnel syndrome, this may be different. This is due to the fact that carpal tunnel syndrome is a latent injury so an injured worker may not know he or she has the injury right away. Lucas v. Angelica Uniform Group, 733 So. 2d 285, 288 (Miss. Ct.
App. 1998).

In other words, carpal tunnel syndrome is a progressive injury that happens when an injured worker becomes aware that he or she had a work related injury. Baker v. IGA Super Valu Food Store, 990 So. 2d 254, 260
(¶19) (Miss. Ct. App. 2008).

When progressive injuries such as carpal tunnel syndrome are involved, the time for filing a Mississippi Worker’s Compensation lawsuit starts from the time a compensable injury becomes reasonably apparent. Tabor Motor Co. v. Garrard, 233 So. 2d 811, 814 (Miss. 1970). The Mississippi Workers’ Compensation Commission determines when a work related injury becomes “reasonably apparent.”
