Trucking Accidents or Wrecks – Trucking Companies Are Required To Check a Driver’s History Before Hiring Them

Title 9, Section 391.23 of the Code of Federal Regulations Requirments

Trucking Companies must investigate every truck driver before they hire them.  A trucking company is required by Section 391.23 to investigate 3 years of a truck driver’s history in every state where the truck driver held a license.  They are also required to investigate the truck driver’s employment record for the 3 years before they apply.  The investigation of the driving history must be made within 30 days of hiring the truck driver. The response from every State must be maintained in the driver’s “qualification file.”

The employment record investigation must also be made within 30 days of hiring the truck drive.  The trucking company or motor carrier as it is also know must keep a written record for each past employer that they contacted and it must include the employer’s name, address, date of contact, and comments.  All of this information must be included in the driver’s qualification file.

This requirement is crucial as we must ensure the safety of the public.  Proper investigations must be conducted to prevent unsafe truck drivers from getting behind the wheel of an 18 wheel truck.  If a trucking company fails to properly investigate a truck driver, this driver may be a extreme liability on the road and could cause a serious wreck which may result in serious injuries.

Mississippi Trucking Wrecks or Accidents

Title 49, Section 391.25 of the CFR requires a trucking company to review the driving record of every truck driver.  This review must happen at least once every 12 months.

This requirement is crucial because it helps prevent trucking accidents and wrecks.  The failure to review the driving record could mean a trucking company has failed to follow the law and thus allowed a truck driver with a poor driving record to continue to work for them.  This failure can lead to serious accidents and wrecks causing catastrophic injuries.

Mississippi Trucking Wreck or Accident – Trucking Companies Must Schedule Loads Giving a Truck Driver Time For Safe Delivery

Frequently, trucking wrecks and accidents with 18 wheelers happens because the driver is in a hurry and speeding.  The truck driver is forced to speed because the trucking company has given the driver a schedule that cannot possibly be met without speeding.  However, Title 49 Section 392.6 of the Code of Federal Regulations provides, in pertinent part,

“No motor carrier shall schedule a run nor permit nor require the operation of any commercial motor vehicle between points in such period of time as would necessitate the commercial motor vehicle being operated at speeds greater than those prescribed by the jurisdictions in or through which the commercial motor vehicle is being operated.”

Another wreck with an 18-wheeler killed a Picayune woman.  Unfortunately, we see far too many wrecks involving 18-wheelers in Mississippi.  Robin Barber died on Texas Flat Road which was near McLeod Park.

Title 49, Section 392.7 of the Code of Federal Regulations has certain pre-trip inspection requirements.  For example, before an 18-wheeler or truck can be driven on the road, a truck driver has a duty to inspect the truck to make sure certain parts and accessories actually work.  The truck driver must make sure that  the brakes work, including the parking brake, the lights work, the tires are okay, the horn works, and other safety devices.

Since 18-wheelers are on the road so much, this inspection is required for safety.  It helps prevents trucking accidents or wrecks involving 18-wheelers which could cause serious injuries.

Mississippi Trucking Wreck or Accident – Wreck With 18 Wheelers Again

Highway 49 in Stone County, Mississippi was shut down by two 18 wheelers that wrecked.  The accident was near the Harrison County and Stone County line.  One of the truck drivers was taken to Forrest General Hospital for treatment for his injuries from the accident.  Large truck wrecks involving 18 wheelers is fairly common in South Mississippi.
